EEOC Posts Guidance Regarding Americans with Disabilities Act opens a new window

The Americans with Disabilities Act prohibits an employer from discriminating against a qualified individual on the basis of a disability. Many employers struggle to interpret and apply this law, especially in light of changes made by the ADA Amendments Act of 2008. Fortunately, the Equal Employment Opportunity Commission, the governmental agency charged with enforcing federal laws that prohibit discrimination, provides helpful resources on its website. One such resource is “The Americans With Disabilities Act: Applying Performance and Conduct Standards to Employees with Disabilities opens a new window” This resource provides practical guidance, including examples, to demonstrate an employer’s responsibilities when performance and conduct problems arise concerning a disabled employee.

2010 ADA Standards for Accessible Design opens a new window

The Department of Justice (DOJ) has compiled an official version of the 2010 ADA Standards for Accessible Design (2010 Standards) to bring together the information in one easy-to-access location. The booklet provides the scoping and technical requirements for new construction and alterations resulting from the adoption of revised 2010 Standards in the final rules for Title II (28 CFR part 35) and Title III (28 CFR part 36).You can go to the Department of Justice's official online version of the 2010 standards in HTML and PDF. At this time either the original 1991 ADA Standards for Accessible Design or the 2010 ADA Standards for Accessible Design may be used, and as of March 15, 2012 only the 2010 ADA Standards for Accessible Design may be used.

Free - Archived Teleconference on EEOC's ADAAA Regulations opens a new window

In response to the new regulations from the EEOC, the ADA National Network presented an audio conference. Sharon Rennert, Senior Attorney Advisor in the EEOC's ADA Division provides an overview of the new regulations.

Customized Employment Videos opens a new window

These Customized Employment (CE) videos, each specifically focused on Employers, Youth, or a General audience, highlight the benefits of CE, an employment strategy which matches the skills and preferences of the individual with the specific business needs of the employer. This process results in expanded employment opportunities for those who utilize and engage in this innovative, evidenced-based approach to employment. The General audience video has been created in both English and Spanish.

FCC Reinstates Rules Requiring Video Description for Television Programming. Full Compliance Required by 7/1/12

The Federal Communications Commission (FCC) has released a requirement under the Twenty-First Century Communications and Video Accessibility Act of 2010 to use video description for certain television programming. Video description is narrated descriptions of a television program’s key visual elements that are inserted into pauses in the program's dialogue. These descriptions improve access to television for people who are blind or visually impaired. Full compliance with the rules is required by July 1, 2012. This link opens a PDF document. ODEP Publishes Study Confirming Workers with Disabilities Meet or Exceed the Job Performance of Co-Workers Without Disabilities

This article is on the Department of Labor’s opens a new window website. Using a case study approach, researchers selected 13 diverse examples from around the nation of partnerships — between employers and trusted workforce intermediaries — with a track record of helping employers recruit, hire, train, and retain employees with disabilities. The goal of this research was to identify successful elements of these strategies and offer lessons that can be learned by employers and employer organizations, workforce development and disability service organizations, and federal, state, and local policymakers.

DOJ: ADA Best Practices Tool Kit for State and Local Governmentsopens a new window

The U.S. Department of Justice issued a new technical assistance document designed to assist state and local officials to improve compliance with the ADA.

The Tool Kit is designed to teach state and local government officials how to identify and fix problems that prevent people with disabilities from gaining equal access to state and local government programs, services, and activities.
